The 2016 Summer Olympic Games are in full swing in Rio de Janeiro. (Go Team USA!) No matter the sport—whether it's archery, gymnastics, swimming or track and field—Olympians are a special breed. While their athleticism certainly sets them apart, I think what makes them extraordinary is their mindset and determination. They're committed to their sport. They're constantly learning—studying their competitors, watching videos of their own performances, and training daily for years (or a lifetime) to reach and exceed their performance goals. No matter what's going on around them or what pains they may need to push through, they're focused on taking home the gold.

What the CFPB Did (and Didn't) Clarify in the
TRID Updates

On July 29, 2016, the Consumer Financial Protection Bureau (CFPB) finally announced its proposed updates to the TILA-RESPA Integrated Disclosure (TRID) or Know Before You Owe rule.

The proposed changes include:

  • Creating tolerance provisions for the total of payments.
  • Allowing lenders to use the Closing Disclosure to show changes in costs that would otherwise be reflected in an updated Loan Estimate.
  • Adjusting a partial exemption that mainly affects housing finance agencies and nonprofits.
  • Extending the rule's coverage to include all cooperative units.
  • Clarifying how a creditor can provide separate disclosure forms to the consumer and the seller.

There are also minor changes that address calculating the cash-to-close table; construction loans, escrow account disclosures, gift funds, lender and seller credits, lenders' and settlement agents' respective responsibilities, partial payment policy disclosures, the payoffs and payments table, rate locks, simultaneous second lien loans and more.

However, one area the CFPB didn't address in the clarifying updates: cure provisions to correct technical errors. Why? According to the proposed rule, "The Bureau is concerned that further definition of cure provisions would not be practicable without substantially undermining incentives for compliance with the rule" and "that further defining cure provisions would be extraordinarily complex."

Don't Forget to Download Point Version 9.4!

If you haven't done so already, we strongly encourage you to log in to MyCalyx® to download Point® 9.4 and deploy the latest update to your users. The focus of this release is to:

 

  • Update Point for the revised HUD form 92900-A, FHA/VA Addendum to the URLA
  • Implement electronic signature capability, through INK-it, for custom documents
  • Enhance the Loan Estimate and Closing Disclosure screens
  • Reconfigure the Fees Worksheet and Closing Costs Worksheet to mirror the Loan Estimate and Closing Disclosure sections
  • Update to support data export for interfaces
  • Implement the Point system requirement for .NET Framework version 4.5 to accommodate TLS 1.2 security certificate updates

GuardianDocs and Point Integration: One Year Later

Last year we announced that the GuardianDocs document preparation service integrated with Point to help streamline the ordering process and support generating and fulfilling loan disclosures and closing packages. So how's the new interface working out for our mutual customers? Well, we'll just let some of them tell you….

Premier Mortgage Resources, a mortgage lender based out of Portland, Oregon, switched to both Point and GuardianDocs last year in anticipation of the coming TILA-RESPA Integrated Disclosure (TRID) rule. According to Cory Swain, Managing Partner at Premier Mortgage Resources: "There was an immediate pick up of probably 25 percent in productivity, and now that we're used to the system we're probably twice as fast as we were [in generating closing documents]. Last month, our two closers did 150 units by themselves. With our old system, I doubt that they'd have gotten through 80."

Richard Matzen, Vice President of Residential Lending at Gateway State Bank in Iowa, experienced a similar boost in productivity after switching to GuardianDocs, stating: "The GuardianDocs/Point interface has probably cut 50 percent or more off of the time that it takes to generate a Closing Disclosure. And it's really easy to make changes on the fly. When you make a change, it happens in an instant. Everything that's in Point gets transferred to GuardianDocs, saving a tremendous amount of data re-entry, which is huge."

Matzen added, "Instead of spending maybe three hours preparing the loan closing document, now I'm doing it in an hour, so that gives me two extra hours to bring in new clients."

GuardianDocs has proven the business case for a full integration with Point—driving significant productivity gains in the post-TRID environment.

ACC Mortgage to Offer New Non-QM Programs Through LO Connect

All Credit Considered Mortgage, Inc. (ACC Mortgage) has selected LO Connect™ from LoanScorecard® as their integrated automated underwriting system (AUS), product and pricing engine (PPE), and distribution solution. ACC Mortgage will soon use this system to offer non-QM programs and pricing to Point users.

LO Connect not only includes the power of the many features in LoanScorecard, but also uniquely integrates with Calyx Point. With LO Connect, third-party originators (TPOs) can see branded product and pricing offers from participating wholesalers in Point. For ACC, these offerings will include non-prime and non-QM loan programs. LO Connect allows TPOs to run upfront decisioning against Custom AUS and receive an in-depth findings report, which delivers an early indication of whether the specific investor will approve the loan when an eligible product and the fully-adjusted price is desired. Additionally, LO Connect eliminates the possibility that information is misquoted to the borrower.

"In the current regulatory environment, it's important to get accurate information upfront in order to provide disclosures correctly and originate in a consistent fashion," said Robert Senko, President of ACC Mortgage. "LO Connect will allow us to offer the broker community the first automated subprime underwriting system to Point users and non-Point users, via our Warp Speed Underwriting, to help streamline the front-end and decisioning of non-QM loans, as well as help us originate compliant loans and grow our wholesale business."
